Are you protecting yourself from Liability? 

The Digital Millennium Copyright Act (DMCA) has been around for almost 27 years.  So, you may be asking yourself why are we talking about it now?  A lawsuit against Cox Communications just last year highlights the need for continued diligence in protecting yourself from copyright infringement liability.  In February 2024, the Fourth Circuit Court of Appeals upheld a lower court’s finding that Cox could be held liable for copyright infringement if it did not terminate the internet connection of subscribers who pirate music. 

eLation’s Copyright Infringement process can almost fully automate the customer identification and notification process for you, while still giving you full visibility into all history and details of the infringement. 

eLation can automatically read the copyright infringement email, identify the customer to which the infringement applies based on DHCP Option 82 information or Static IP, and create an Activity Log entry containing the infringement details.  (Note: The ability to tie the customer to the IP Address does require IP Diagnostics.) 

Then, our Account Notification process and Advanced Search can be used to automatically send notifications to the subscribers in the form of Paper, Email, and/or SMS Texting. 

Because the Activity Log tracks all notifications sent, it can be used in conjunction with scheduled Advanced Searches to automatically identify repeat offenders for whom a harsher notification or service disconnect is required.
